No Case to Answer in Immigration Employment Case

Case update: no case to answer

Today our Principal Solicitor, CHAUDHRY M. Kamran, appeared for the defence in a Magistrates' Court trial. Our client faced a charge of taking employment while being a person in respect of whom a removal order is in force, contrary to section 38AA(1)(b) and (2) of the Immigration Ordinance (Cap. 115).

At the close of the prosecution case, Mr Chaudhry made a submission of no case to answer. The Magistrate upheld the submission and dismissed the charge. Costs were awarded to the defendant.

Charges under the Immigration Ordinance can have serious consequences for a person's liberty and status in Hong Kong. Anyone facing such a charge should seek legal advice at the earliest opportunity.

Each case turns on its own facts, and past outcomes do not guarantee future results.
