Fraud Trial Acquittal

Our firm recently acted for a client who stood trial on a charge of fraud. The client was acquitted.

Ms. Diane Crebbin appeared as counsel for the defence. She was assisted by our solicitor Nigel Sharman and our trainee solicitor Simran Sajhwani, who prepared the case with her and worked on it through the trial.
At the close of the prosecution case, the court ruled that there was a case to answer. That ruling is often misunderstood by clients, and understandably so. It is not a finding of guilt, and it is not an indication of where the case is heading. It means only that the prosecution evidence, taken at its highest, was capable in law of supporting a conviction. The threshold is a low one and it is meant to be.
The trial continued. After closing submissions, the court was not satisfied of guilt to the criminal standard and the client was acquitted.

Our thanks to Ms Crebbin for her conduct of the trial, and to Nigel and Simran for the preparation behind it. For Simran, this was almost the end her training, and this case clearly shows that she is ready for the next chapter of her career.
